H-2B Temporary Non-agricultural program  
 

This H-2B program assists employers who cannot find U.S. workers who are qualified, willing, able, or available to fill their openings. Your need is considered temporary if it is a one-time occurrence or a seasonal need. 
 
The 2015 Interim Final Rule was published April 29, 2015.  This rule requires more involvement with the recruitment process from the State Workforce Agency (SWA).  Another change concerns the 2015 Final Wage Rule.  Access both Final Rules at http://www.foreignlaborcert.doleta.gov/.

The New Interim Final Rule made it necessary to update our H-2B Job Order Request form.  The old version will not be accepted for processing.  Email us the completed Form JFS 01809 Foreign Labor Certification Request for H-2B Job Order to flc@jfs.ohio.gov. The ETA Form 9142B must be filed with the Chicago National Processing Center at the same time you submit this request form to Ohio Foreign labor Certification (known as SWA). Steps of the filing process are:

• You, the employer, must register with the Chicago National Processing Center no less than 120 calendar days before your start date of need and no more than 150 calendar days before your start date of need.

• You must file the Prevailing Wage Request around 60 calendar days before the date the determination is needed.

• You must file the H-2B Job Order Request Form with us, Ohio Foreign Labor Certification, at the same time you file the ETA Form 9142B no less than 75 calendar days from your start date of need and no more than 90 calendar days from your start date of need.

• We will write a job order which will remain open up to 21 days prior to the start date of need.

• After we receive the National Processing Center’s Notice of Acceptance, we will to you and your legal representative, if applicable, the job order number, the dates the job order opens and closes.

• We will provide you with all qualified, interested job seekers' contact information through email or by phone.

• You shall interview, in person or by phone, all qualified referrals made by us.

• You shall submit the hiring results to us immediately after interviewing the referral.
