H-2B Non-Agricultural Foreign Labor Certification

            In January, 2009, new Federal Regulations went into effect which govern the H-2B application process.  All H-2B applications are now filed with the Chicago National Processing Center.  Filing procedures can be found at http://www.foreignlaborcert.doleta.gov.  All questions regarding the new regulations must be e-mailed to H-2BRegulation@dol.gov

            Due to the new Final Rule, Ohio FLC will now assist Ohio employers with:

 Job Orders   

            The State of Ohio will write the job orders for H-2B applications.  Ohio FLC recommends that the employer obtain a prevailing wage determination    from the U.S. DOL Office of Foreign Labor Certification (Ohio FLC no longer provides the prevailing wage determinations for H-2B applications) prior to requesting Ohio FLC to write a job order.

             Verification of Employment Eligibility for all ODJFS Referrals   

            Ohio will provide the employer with verification of each ODJFS referral’s eligibility to work within the United States.
