In the H-2A program, the State Workforce Agency reviews the content of employer job orders prior to employer submission of the H2-A application to the Chicago National Processing Center (CNPC) who places approved job orders for intra- and interstate recruitment of U.S. workers, and conducts safety inspections of employer-provided housing for temporary agricultural workers.

In Ohio, the employer is required to complete the following: 

Email a completed Form ETA 790 Agricultural and Food Processing Clearance Order to flc@jfs.ohio.gov. You will receive an automated email from us which lets you know we have received your documents. If you do not receive this email within 24 hours, please email us.   

HOUSING:
 
Rental housing.  You must provide an attestation statement for housing in Item 28 (identified as Item 3 information) of the ETA 790.  To ensure the housing meets OSHA standards,  email us to request a copy of the checklist. 

  • housing type (single house, barracks, etc)
  • complete physical address of the housing units, including county
  • the proposed capacity for each unit
  • the occupancy dates for each unit
  • well water inspection results if rental does not use city water
  • a dated rental agreement, signed by both employer and lessor covering the period of need

    If more than one rental property is used, the above information is required for each address.

Employer-owned housing. You must send us an email requesting a housing inspection for the housing identified in Item 3 of the ETA 790.   

Hotel or motel. You must provide a statement on hotel or motel letterhead detailing: 

  • the number of rooms you are renting;
  • the dates the rooms will be rented;
  • the number of beds in each room;
  • whether the rooms provide full cooking and food storage facilities; or
  • menus from the restaurants in the hotel/motel area.
