| Foreign Labor Certification (FLC) provides a way for Ohio employers to hire foreign workers if U.S. workers are not able, willing, qualified, and available to fill job openings. As the first stage of employment based immigration, FLC programs are designed to ensure that the admission of foreign workers into the United States on a permanent or temporary basis will not adversely affect the job opportunities, wages, and working conditions of U.S. workers. The Ohio FLC unit coordinates the review of H-2A temporary agriculture applications with the Chicago National Processing Center (CNPC). The FLC Unit writes the job orders after the terms and conditions of employment are found to be compliant with federal regulations. |

The CNPC ultimately makes the decision whether or not to approve/certify H-2A applications. Local One-Stop Centers work with employers by referring job seekers to them. Employers should consult with their local One-Stop Center in order to document their efforts to recruit U.S. workers.
