Effective until January 1, 2010 Ohio Foreign Labor Certification provides prevailing wage determinations for only those positions for which an application for foreign labor certification is being filed: • Permanent Foreign Labor Certification • H-1B Professional Temporary Foreign Labor Certification • H-2B Temporary Non-Agricultural Foreign Labor Certification
General Information Prevailing wage requests are reviewed as quickly as possible, in the order they are received. A determination should be made within 30 days. It is not necessary to contact Ohio FLC to get the status of your prevailing wage requests. Just logon to your online account. You may then check the status or print the determination(s) you need.
When the request is successfully submitted, you will receive a pop-up screen stating the SWA Tracking Number.
The prevailing wage determination may be used for more than one application, as long as all job related details and the area of intended employment remain the same. Under 20 CFR 656.40(i), the Wage cannot be lower than required by any other law. No prevailing wage determination for foreign labor certification purposes made under this section permits an employer to pay a wage lower than the highest wage required by any applicable Federal, state, or local law.

A request for reconsideration of a Prevailing Wage determination, can be submitted by email or mail within 30 days of the determination date. You will receive a response to your request within 30 days of its receipt in this office.
How to File To file a prevailing wage request with the State of Ohio, just logon to http://www.odjfs.state.oh.us/owd/flc-pw/. and follow the step-by-step directions. If you are a first time user, you need to register for an account by clicking on the link at the bottom of the page. If there is a possibility that more than one person from your business will need to access the determinations, it is recommended you set up a "corporate" registry. Create a user name and password, and list an e-mail address that anyone in your company can access.
Suggestions for Filing Online • When registering, place only your information on the registration form. • Complete all fields on the registration form and the prevailing wage request form. • Place in each field only information which belongs in that field. • If you are submitting a prevailing wage request for a position covered by a Collective Bargaining Agreement or Union contract - o mark that section on the Prevailing Wage Request form; o e-mail or mail only the information pertaining to the wages, referencing the SWA Tracking Number assigned to your request • If you are submitting a survey - send the survey by e-mail or mail, referencing the SWA Tracking Number assigned to your request. |
