Ohio Foreign Labor Certification (FLC) assists Ohio employers in hiring foreign workers when there are an insufficient number of U.S. workers who are willing, able, or available to perform the job.  This is done by:

• Providing a prevailing wage determination for Permanent, H-1B (professional temporary), and H-2B (non-agricultural temporary) applications filed with Ohio.  For further information, go to How to file for an Ohio Prevailing Wage Determination.
• Reviewing for acceptance, and guiding the employer through recruitment, of all H-2B applications filed with Ohio.  For information, go to Filing a Labor Certification Application.
• Conducting recruitment for, and inspecting housing of, all Ohio H-2A applicants.  For complete information, go to Foreign Labor Certification Filing Instructions - Temporary (H-2A Agricultural).
• How to place a job order

An employer must meet the following criteria:

• Must be an Ohio employer; this can be documented by:
  • Providing an Ohio Unemployment Compensation Number.  If you do not have an Ohio Unemployment Compensation number, go to http://jfs.ohio.gov/ouc/; and
  • Providing a Federal Identification Number (for information, go to http://www.irs.gov/businesses/small/article/0,,id=98350,00.html) and
  • The job site / or employer's corporate office must be located in Ohio

Failure to provide the above documentation with the initial filing can cause delays in the foreign labor certification application process.
